Dog Control Order Penalties Issued

The table below lists the penalties issued by Newcastle-under-Lyme Borough Council in respect of dog controls.

The following Dog Control Orders operated between 1 April 2013 and 20 October 2017:

  • The Fouling of Land by Dogs (Borough of Newcastle-under-Lyme) Order 2013
  • The Dogs on Leads (Borough of Newcastle-under-Lyme) Order 2013
  • The Dogs on Leads by Direction (Borough of Newcastle-under-Lyme) Order 2013
  • The Dogs Exclusion (Borough of Newcastle-under-Lyme) Order 2013

A Public Space Protection Orders (PSPO) was adopted on 21 October 2017, replacing previous dog control orders. The Public Spaces Protection Order is currently due to remain in force until September 2020.

Where a fixed penalty notice (FPN) is issued, the recipient has up to 14 days to pay. We accept a lower payment if paid within 10 days, otherwise the charge is the standard charge. If the FPN remains unpaid, cases are referred to the magistrates' court. The court can impose a fine of up to £1,000 and award costs. There is no formal right to appeal a FPN. Recipients can contact the Borough Council if they feel our actions were unfair and a manager will consider the extra information they supply. If a FPN remains disputed, the alleged offender has the opportunity to plead not guilty and offer their defence to the magistrate.

Up until October 2017 the lower payment we would accept was £50 and the standard payment £75.  Currently the lower rate of £75 and the standard payment of £100 applies.  Levels of fine are set by legilsation which prescribes maximum and minimum values.  Councillors agree the sum which should be charged annually as part of the council's fees and charges setting process.
