Swimming lesson direct debit terms and conditions

Programme and facility 

  1. The Learn to Swim programme operates over 50 weeks of the year, your child will be allocated 1 swimming lessons per week and each lesson is 30 minutes in duration (including registration). 

  1. You may request a change of time, day or swimming teacher and we will try to accommodate your request, provided a space is available. 

  1. The Learn to Swim programme charges will be reviewed annually and determined by Newcastle-under-Lyme Borough Council. Jubilee2 will endeavor to deliver classes as stated in the timetable, however, should unforeseen circumstances arise, we reserve the right to amend the learn to swim timetable as and when necessary. 

  1. All juniors in the learn to swim programme will be eligible for free swimming at Jubilee2 facilities. Junior members under 8 years of age must be accompanied by an adult in the pool during Leisure Swims, at the standard fee. All swims must be booked before attending. 

  1. All users of Jubilee2 will need to download and log in to our new Flow App to gain access. Jubilee2 app  families can be linked to each other for parents to access their child’s barcode.

  1. If you have a Lyme card this can be linked to your new account on Flow. (please speak to a member of the reception team) 

  1. Swimming lessons are not transferable. 

  1. Attempted use of the Member card by a non-member will result in the cancellation of swimming lessons without any refund of fees already paid. The Member card must be presented on every leisure swim visit to gain access. Jubilee2 operates a 'no member card, no entry' policy, the full price of the activity is paid. 

  1. A photograph is required for all membership accounts and will be taken at reception or the user can update a picture on their online account 

  1. Access to swimming lessons/public sessions is valid from the date of the first payment. 

  1. Spectating is not permitted on either poolside. Parents and spectators may watch lessons from the café area or the balcony. Please note that only food and drinks purchased from the café may be consumed in the café seating area. 

Direct debit payments 

  1. Direct debits will be collected on the 5th of each month, or next banking day. The initial direct debit will include an element of a pro-rata payment dependent on date of the next swimming lesson. 

  1. Your Direct Debit will be collected on your chosen payment date. If payment is unsuccessful, we will automatically make up to two further attempts to collect the outstanding amount. 

  1. If payment remains unpaid and your membership is still within its minimum contract period, Newcastle-under-Lyme Borough Council reserves the right to recover the outstanding balance. This may include referral to a debt recovery agency and/or legal action through the civil courts. 

  1. By signing the direct debit mandate, you are confirming that you are authorised to set up payments from the account for a minimum period of 3 months. 

  1. Any member paying by direct debit will be notified of any changes to their direct debit payment. To opt out at any time, after the minimum contract period, a minimum of one calendar month’s written notice is required. This can be done by emailing J2Aquatics@newcastle-staffs.gov.uk

  1. The council may change your direct debit payment fee at any time upon giving three months’ notice of its intention to do so. 

  1. The council may give such notice by e-mail or by notice board information at its sports facility. Where such changes are required to be put into effect a change in the VAT rate then the obligation to give prior notice shall not apply. 

  1. Direct debit is for a minimum period of 3 months. Payees can cancel at any time after 3 months of direct debit has been completed but must give a minimum of one calendar months’ notice in writing. This can be done by emailing J2Aquatics@newcastle-staffs.gov.uk 

  1. Swimming lessons may only be frozen for medical reasons and are subject to the discretion of Jubilee2. Requests to freeze lessons must be submitted by emailing J2Aquatics@newcastle-staffs.gov.uk and must be supported by appropriate medical evidence, such as a doctor's note or medical certificate. Direct Debit payments must continue during the approved freeze period to retain the swimmer's lesson space. Once the swimmer returns to lessons, any eligible credits accrued during the approved freeze period will be deducted from future Direct Debit payments. 

  1. If the Direct Debit instruction is cancelled, rejected, or otherwise becomes inactive at any point, whether by the payer or the bank, the account will be cancelled and the children will be removed from their lessons. A new Direct Debit mandate will need to be completed, and a new membership added to the account. Once this has been completed, reception will be able to rebook the children into their class. 

Cancellations 

  1. Debit payment is due. If your cancellation is received after this deadline, you will be liable for one further Direct Debit payment, and your swimming lessons will continue until the end of that payment period. 

  1. It is the responsibility of the Direct Debit holder to ensure that a cancellation request is emailed to J2Aquatics@newcastle-staffs.gov.uk and that the Direct Debit instruction is cancelled with their bank. Failure to complete both steps may result in further payments being collected, and any payments taken in these circumstances will not be refunded. 

  1. Jubilee2 will provide a qualified swimming teacher for every lesson. If a regular teacher is unavailable for any reason, Jubilee2 will make every reasonable effort to provide a suitably qualified replacement. If no replacement teacher can be arranged, the lesson will be cancelled, and a credit will be applied to your account. Where the cancelled lesson falls at least 7 days before the next Direct Debit is due, the credit will be deducted from the upcoming payment where possible; otherwise, it will be applied to the following month's Direct Debit. 

  1. If lessons are cancelled, notification will be sent by email and text message using the contact details held on the child's account. It is the parent or guardian's responsibility to ensure that these contact details are accurate and kept up to date. 

Parent's membership 

  1. All parents must have an account to access the facilities. This can be done by downloading our Flow App and becoming a member.

  1. A subscription will be added to your card every 1 year at reception when you attend for your first session.  

Swimwear 

  1. Appropriate swimwear must be worn in conjunction with Jubilee2 dress code for bather’s policy. 

  1. Babies and toddlers must wear suitable leak-proof swim pants that will help contain leakage in the event of accidental soiling. 

Personal information 

  1. Jubilee2 undertakes to use personal information responsibly, in accordance with the law, keeping it accurate and up to date. It is the member's responsibility to ensure that any changes to the personal details provided are advised immediately.
