What is a statutory odour nuisance?
A nuisance threshold is not just the detection of odour/smell.
You may smell an odour on occasions but this may not be a nuisance. A statutory nuisance is a higher threshold and requiring an assessment of how the smell ‘materially affects the use and enjoyment of your property’.
It has to take into account such matters as:
- the nature of the smell
- the frequency of the smell
- the intensity of the smell
- the duration
- the offensiveness
- the location
- the impact that this has
