What is a statutory odour nuisance?

A nuisance threshold is not just the detection of odour/smell.

You may smell an odour on occasions but this may not be a nuisance. A statutory nuisance is a higher threshold and requiring an assessment of how the smell ‘materially affects the use and enjoyment of your property’.

It has to take into account such matters as:

  • the nature of the smell,
  • the frequency of the smell,
  • the intensity of the smell,
  • the duration,
  • the offensiveness,
  • the location and,
  • the impact that this has.
